Virginia Child Custody & Visitation Laws

The court may award either joint custody, sole custody, or a combination of both. Joint legal custody means both parents retain decision-making rights, while joint physical custody means the child spends exactly 50 percent of his or her time with each parent. Keep in mind, when the court grants joint physical custody, one parent will still obtain primary physical custody and be the designated “custodial parent.”

On the other hand, sole legal custody means one parent makes all the decisions regarding the child, while sole physical custody means the child will exclusively live with and be under the supervision of one parent.

If both parents agree on all terms of the custody arrangement and create a plan together, the court will generally find that your arrangement is in the child’s best interest, and a judge will then sign your agreement. If parents have some unresolved issues, they may participate in mediation and have a mediator help them reach an agreement.

However, if both parents cannot reach an agreement despite mediation efforts, then the court will decide custody. A judge will consider the best interests of the child.

The court will examine the factors contained in VA Code § 20-124.3, including:

  • The child’s age
  • The child’s physical and mental health
  • Each parent’s physical and mental health
  • Each parent’s existing relationship with the child
  • The child’s needs, including family relationships
  • Each parent’s role in the child’s upbringing

How Our Firm Approaches Custody & Visitation Cases

As your case moves forward, we stay in close contact to prepare you for mediation, settlement conferences, or trial if needed. Our team reviews documents, proposed parenting plans, and communication with the other parent with you so that you can make informed choices about offers and counteroffers. When settlement is possible, we help you craft detailed schedules and decision-making provisions that are practical for your work obligations, your child’s school and activities, and any transportation challenges in and around Manassas and the surrounding communities.

If litigation becomes necessary, we prepare by gathering school records, medical information, and witness testimony that may help the judge evaluate the statutory best-interests factors. We also help you understand courtroom procedures, such as how evidence is presented and how you may be questioned, so you feel as prepared as possible on the day of your hearing. Throughout the case, our focus remains on practical solutions that reduce conflict where possible while still protecting your child’s well-being.

Frequently Asked Questions

How Long Does a Child Custody Case Usually Take in Virginia?

The length of a custody case depends on how many issues are disputed and the court’s schedule. Some families can obtain a temporary order within a few months and a final order several months later, especially if they are able to reach an agreement in mediation.

Can a Custody or Visitation Order Be Changed Later?

Yes. In Virginia, custody and visitation orders can be modified when there has been a material change in circumstances and a new arrangement would be in the child’s best interests. Examples may include a parent’s relocation, changes in a child’s needs, or significant shifts in a parent’s work schedule or health. To request a change, you generally file a motion in the same court that issued the prior order, such as the Prince William County Juvenile and Domestic Relations District Court, and the judge will decide whether an updated schedule is appropriate.

What Should I Bring to My First Meeting About Custody or Visitation?

For an initial consultation, it is helpful to bring any existing court orders, prior agreements, and important information about your child’s schedule and needs. Many parents also gather recent school records, medical information, and a brief written timeline of major events or concerns they want to discuss. Having this material ready allows the attorney to quickly spot legal issues, assess potential options under Virginia law, and outline next steps with you. Being organized from the start can make the process more efficient and help you feel more in control of what comes next.
